Judicial Compromise Under Military Pressure

In the last three years, Pakistan’s judiciary has faced severe compromise due to pressure from Pak Army generals. The public has completely lost trust in the judges, who, like sheep, follow the orders of General Asim and his gang of criminal army officers since the army overthrew the duly elected and popular government of Imran Khan in April 2022.

Importantly, judges disregard the oath they took under the constitution and the Code of Conduct they agreed to, issued by the Supreme Judicial Council of Pakistan. Under threats, some judges opted for retirement, but others happily sell their judgments like prostitutes sell sexual favors. Those who retired lacked courage and failed to stand up for the constitution and rule of law.

Moreover, those who align with the generals continue to collect paychecks, perks, and plots, prostituting themselves for material benefits. A few judges who strive to honor their oath to the constitution and follow the Code of Conduct get replaced by new judges from lower ranks or reassigned to distant locations.

For their material gains, newly appointed judges willingly replace those who demonstrated character, integrity, and loyalty to the constitution. Consequently, this reveals an alarming abundance of prostitute-judges in Pakistan, who lack dignity for themselves and their families and, more importantly, show no regard for Pakistan’s judiciary or the remaining sliver of dignity left in the institution.

Compromised Judgements and Military Influence

Most judges, from the lower courts to the Supreme Court, exhibit severe compromise. Military officers or their subcontractors draft the judgments that these judges read in court. As a result, the judges have abandoned their oath and the Code of Conduct they vowed to uphold.

The Judicial Oath and Code of Conduct

From the website of the Supreme Court of Pakistan, the oath of office for judges in Pakistan includes the following:

  • The oath begins with “In the name of Allah, the most Beneficent, the most Merciful”
  • The judge swears to be faithful and loyal to Pakistan
  • The judge swears to perform their duties honestly, faithfully, and in accordance with the law
  • The judge swears to abide by the Supreme Judicial Council’s Code of Conduct*
  • The judge swears to not let personal interests influence their decisions
  • The judge swears to protect the Constitution
  • The judge swears to treat everyone fairly and equally, without favoritism

The Code of Conduct, as agreed by the Supreme Judicial Council, has 11 Articles.

Article 2 says:

“A Judge should be God-fearing, law-abiding, abstemious, truthful of tongue, wise in opinion, cautious and forbearing, blameless, and untouched by greed. While dispensing justice, he should be strong without being rough, polite without being weak, awe inspiring in his warnings and faithful to his word, always preserving calmness, balance and complete detachment, for the formation of correct conclusions in all matters coming before him. In the matter of taking his seat and of rising from his seat, he shall be punctilious in point of time, mindful of the courtesies, careful to preserve the dignity of the Court, while maintaining an equal aspect towards all litigants as well as lawyers appearing before him.”

ARTICLE- 11 says:

“No Judge of the superior judiciary shall render support in any manner whatsoever, including taking or administering oath in violation of the oath of office prescribed in the Third Schedule to the Constitution, to any authority that acquires power otherwise than through the modes envisaged by the Constitution of Pakistan.”

Please recall and compare the retired so-called “Honorable” Chief justice of Pakistan, Qazi Isa’s (and many other judges’) conduct and temperament in the court against the above, Article 2 and 11.
